Terms of Service
Effective Date: January 1, 2024
Please read these terms carefully before using OnPoint Mobile Drug Alcohol & DNA Testing services. These terms govern your relationship with us.
1. Acceptance of Terms
By booking a service, accessing our website, or using any OnPoint Mobile Drug Alcohol & DNA Testing platform, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.
2. Services Provided
OnPoint Mobile Drug Alcohol & DNA Testing provides mobile specimen collection services including drug testing, alcohol screening, DNA testing, background screening facilitation, and fingerprinting. We are a collection service and do not perform laboratory analysis directly. Results are processed by SAMHSA-certified third-party laboratories.
3. Eligibility
You must be at least 18 years of age to book services independently. Minors may be tested only with written parental or legal guardian consent. By using our services, you represent that you meet this eligibility requirement.
4. Scheduling & Cancellations
Appointments must be cancelled at least 2 hours before the scheduled time to avoid a cancellation fee. For ASAP/immediate dispatch requests, cancellations must be made before the technician departs. Late cancellations or no-shows may be subject to a fee of up to $50. We reserve the right to reschedule appointments due to technician availability or emergency circumstances.
5. Payment Terms
Payment is due at the time of booking or service delivery as specified. Prices are subject to change without notice. Any applicable mobile fees, after-hours surcharges, or emergency fees will be disclosed prior to confirmation. We accept major credit cards and approved payment methods. All sales are final unless otherwise stated.
6. Accuracy of Results
We collect specimens following SAMHSA and DOT chain-of-custody protocols to ensure accuracy. However, specimen collection results depend on proper donor compliance, laboratory processing, and medical review. OnPoint Mobile Drug Alcohol & DNA Testing is not liable for results affected by donor non-compliance, tampered specimens, or laboratory error. All MRO-reviewed results are final.
7. Confidentiality of Results
Test results will only be released to the individual tested, the ordering employer (if applicable), or as required by law. Employer-mandated results are governed by a separate service agreement. We do not release results to unauthorized third parties under any circumstances.
8. Consent to Collection
By proceeding with a test, the donor consents to specimen collection and authorizes OnPoint Mobile Drug Alcohol & DNA Testing and its laboratory partners to process the specimen for the purposes specified at booking. Donors have the right to refuse, but refusal may be reported to the requesting employer under DOT regulations.
9. Limitation of Liability
OnPoint Mobile Drug Alcohol & DNA Testing's liability is limited to the cost of the service rendered. We are not liable for any indirect, incidental, or consequential damages arising from the use of our services, including employment decisions made based on test results. Our total liability shall not exceed the amount paid for the specific service in question.
10. Prohibited Use
You agree not to attempt to tamper with, adulterate, or substitute any specimen. Specimen tampering is a violation of federal law (for DOT-regulated tests) and may result in service refusal, result reporting as a refusal to test, and potential legal consequences. Any fraudulent booking or misrepresentation of identity is strictly prohibited.
11. Intellectual Property
All content on our website and platform, including text, graphics, logos, and software, is the property of OnPoint Mobile Drug Alcohol & DNA Testing and protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our express written permission.
12. Governing Law
These Terms are governed by the laws of the State of Florida. Any disputes shall be resolved in the courts of Broward County, Florida, or through binding arbitration at our election.
13. Changes to Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Continued use of our services constitutes acceptance of the updated Terms.
